On January, 21 Sergei Rossomakhov, Trade Representative of Russia in Indonesia, shared an overview of the Russian Arbitration system at an International Webinar “A Comparison of the Enforcement Arbitration Awards: Russia, Spain, Honduras, and Indonesia” organized by Bursa Hukum.

Key points on Arbitration in Russia:

The international commercial arbitration is administered in accordance with the Russian Federal Law on Arbitration, the Russian Law on International Commercial Arbitration as well as Arbitration Rules.

The Federal Law on International Commercial Arbitration, 1993 (the "Law") and amended in 2017 governs international commercial arbitration throughout the entire territory of Russia. 

Russia is a party to the New York Convention and has been one of the original member states since 1958 (as USSR). Our country has adopted the UNCITRAL Model Law (without the 2006 amendments) in the International Commercial Arbitration Law (ICA Law). 

Russian law has adopted the requirement that in order to administer Russia-seated arbitrations, any arbitral institutions (including those located abroad) must obtain licences from the Russian Ministry of Justice. Only arbitrations administered by licensed arbitral institutions are considered institutional arbitrations for the purposes of the Russian arbitration law.

The International Commercial Arbitration Court at the Russian Chamber of Commerce and Industry (ICAC), the Maritime Arbitration Commission at the Russian Chamber of Commerce and Industry (MAC), the Arbitration Centre at the Russian Union of Industrialists and Entrepreneurs, the Russian Arbitration Centre at the Russian Institute of Modern Arbitration (RAC) and the National Centre of Sports Arbitration at the Sports Arbitration Chamber (ANO) are Russian licensed arbitral institutions. As regards foreign licensed arbitral institutions, the Hong Kong International Arbitration Centre (HKIAC) and the Vienna International Arbitral Centre (VIAC) have obtained the status of permanent arbitral institutions and are able to administer international arbitrations seated in Russia.
